Supreme Court Sends Contempt Notice to Patanjali for Allegedly Misleading Advertisements

The Supreme Court issued a contempt-of-court notice to Patanjali Ayurveda and its managing director, Acharya Balkrishna, alleging a breach of the undertaking not to advertise drugs or make derogatory statements against any medical system. Justices Hima Kohli and Ahnasuddin Amanullah restrained Patanjali from advertising or branding its products for treating diseases as per the Drugs and Magic Remedies (Objectionable Advertisement) Act 1954. This decision stemmed from a petition by the Indian Medical Association (IMA), which accused Patanjali of conducting a smear campaign against modern medicine and vaccination.

Previously, on November 21, 2023, Patanjali assured the court that it would adhere to all laws related to product advertising and refrain from making casual statements about medicinal efficacy or disparaging any medical system. However, during the recent hearing, senior advocate PS Patwalia, representing the IMA, informed the court that Patanjali continued to promote its medicines’ effectiveness, which contravenes the Drugs and Magic Remedies (Objectionable Advertisements) Act.

Supreme Court on PatanjaliJustice Amanullan expressed dismay at Patanjali’s actions, questioning how the company could make such claims after giving assurances to the court. He emphasized the severity of the matter, indicating a potential strong response from the court. Later in the day, Justice Amanullah raised concerns about the delay in addressing the issue since the petition was filed two years ago. He criticized the Ayush ministry’s inaction, stating that the country had been misled for two years, despite clear prohibitions under the Drugs Act.

Additional Solicitor-General KM Nataraj assured the court that the government would provide a comprehensive response after coordinating with various departments to verify the claims. The case underscores the importance of adhering to advertising regulations and maintaining integrity in promoting healthcare products.
